These Terms of Service (“Terms”) govern your access to and use of UI Engineering Excellence, a Substack-hosted newsletter and blog at https://blog.robhameetman.com (the “Blog”). By subscribing to or using the Blog, you agree to be bound by these Terms. If you do not agree, please do not access or use the Blog.

1. Changes to These Terms

We may update these Terms at any time by posting a revised version on the Blog. The “Last updated” date at the top will reflect significant changes. Your continued use after changes constitutes acceptance of the new Terms.

2. Eligibility

You must be at least 13 years old to subscribe or comment. By using the Blog, you represent and warrant that you meet this age requirement.

3. License to Use Content

• Personal Use: We grant you a limited, non-exclusive, revocable license to view, share, and interact with Blog content for personal, non-commercial purposes.

• Restrictions: You may not copy, reproduce, modify, distribute, publish, sell, or create derivative works of any content (text, images, code, etc.) without our express written permission.

4. Subscriptions & Billing

• Free and Paid Plans: Substack, Inc. (“Substack”) manages all subscription enrollments, renewals, cancellations, and email delivery. Paid subscriptions are processed via Stripe, Inc. (“Stripe”).

• Payment Disputes & Refunds: Any questions, disputes, or refund requests relating to subscription charges must be directed to Substack Support (support@substack.com) or handled through your Substack account dashboard. We do not process payments or refunds directly.

• Pricing Changes: We may change subscription fees at any time; existing subscribers will be notified and will have the option to cancel before a new rate takes effect.

5. User-Generated Content

• Comments & Notes: When you post comments or “notes” on the Blog, you grant us and Substack a perpetual, royalty-free, worldwide, sublicensable license to use, reproduce, modify, adapt, publish, and display that content.

• Responsibility: You are solely responsible for your submissions. You must ensure your content does not infringe third-party rights, violate these Terms, or break any laws.

6. Prohibited Conduct

You agree not to:

• Post content that is unlawful, defamatory, obscene, threatening, or harassing.

• Impersonate any person or entity.

• Use bots, scrapers, or other automated tools to access or collect data from the Blog.

• Interfere with or disrupt the Blog’s operation or security.

7. Third-Party Links and Services

• External Links: The Blog may contain links to third-party websites. We do not endorse and are not responsible for their content or privacy practices.

• Service Providers: Substack and Stripe are independent contractors; their terms and privacy policies apply to the services they provide. You should review Substack’s Terms of Service (https://substack.com/terms) and Stripe’s Terms (https://stripe.com/legal) for details.

8. Intellectual Property

All trademarks, service marks, logos, and other intellectual property on the Blog (“Marks”) are owned or licensed by us. You agree not to display or use our Marks without prior written permission.

9. Disclaimer of Warranties

THE BLOG AND ALL CONTENT ARE PROVIDED “AS-IS” AND “AS-AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL UI ENGINEERING EXCELLENCE, ITS AUTHOR, SUBSTACK, OR STRIPE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR ACCESS OR USE OF THE BLOG.

11. Indemnification

You agree to indemnify, defend, and hold harmless UI Engineering Excellence, its affiliates, officers, directors, employees, and agents (including Substack and Stripe) from any claim, liability, loss, or expense (including attorneys’ fees) arising out of your breach of these Terms or your violation of any law or third-party rights.

12. Termination

We may suspend or terminate your access to the Blog at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Blog. Upon termination, your rights under these Terms will immediately cease.

13. Governing Law & Dispute Resolution

These Terms and any dispute arising out of them shall be governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any legal action must be brought in the state or federal courts located in Cook County, Illinois.

14. Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with Substack’s and Stripe’s applicable terms, constitute the entire agreement between you and us regarding the Blog.
